Barakah Emporium Terms of Use

Introduction

Welcome to Barakah Emporium (“we,” “our,” “us”). These Terms of Use (“Terms”) govern your use of our website, services, and marketplace (collectively, the “Platform”). By accessing or using the

Platform, you agree to be bound by these Terms and all applicable laws. If you do not agree, you must discontinue use immediately.

 

1. Eligibility & Account Registration

You must be at least 18 years old to use Barakah Emporium. By creating an account, you represent that all information provided is accurate and complete. You are responsible for maintaining the

confidentiality of your account credentials and for all activity under your account.

 

2. Use of the Platform

You agree to use the Platform for lawful purposes only and in accordance with these Terms. You may not use the Platform in any way that violates applicable laws or regulations, impersonates others,

transmits harmful code, or disrupts operations.

 

3. Vendor Accounts & Listings

Vendors may register to sell products through the Platform. Vendors are responsible for product

accuracy, safety, and legality. By submitting content (including images and product descriptions),

vendors grant Barakah Emporium a non-exclusive, royalty-free license to use, display, and promote  their materials for marketing and operations. We may remove listings that violate standards or brand values.

 

4. Orders, Payments & Transactions

Transactions are processed in Canadian dollars (CAD) unless otherwise stated. Payment is securely   handled through third-party processors. Barakah Emporium acts as a marketplace facilitator and is not the seller of record for third-party vendor products. Disputes must be handled with the vendor, though  we may assist at our discretion.

 

5. Intellectual Property

All content on the Platform—including logos, trademarks, designs, and photography—is owned by

Barakah Emporium or licensors. You may not reproduce or distribute materials without written consent. Unauthorized use may violate copyright or trademark laws.

6. User Content

Users may post reviews or feedback (“User Content”) that is lawful and respectful. By posting, you grant Barakah Emporium a perpetual, royalty-free license to use and display such content for

promotional purposes. We may remove any content violating these Terms.

7. Product Descriptions & Accuracy

We strive for accuracy but do not guarantee product details or pricing are error-free. We reserve the right to correct errors or cancel orders if inaccuracies are discovered.

 

8. Third-Party Links & External Sites

Links to external websites are provided for convenience. Barakah Emporium is not responsible for the content or policies of those sites and access is at your own risk.

 

9. Disclaimer of Warranties

The Platform and its content are provided “as is” without warranties of any kind. Barakah Emporium

disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

10. Limitation of Liability

To the fullest extent permitted by law, Barakah Emporium shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform. Our total liability shall not exceed the total  amount paid by you for the product or service at issue.

 

11. Indemnification

You agree to indemnify and hold harmless Barakah Emporium, its affiliates, and employees from any claims arising from your use of the Platform or violation of these Terms.

 

12. Arbitration & Dispute Resolution

Any disputes shall be resolved through confidential binding arbitration in Toronto, Ontario, under the  ADR Institute of Canada’s rules. Both parties waive class action and jury trial rights. Either party may seek injunctive relief for intellectual property disputes in court.

 

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Ontario and Canada. Any disputes not subject to arbitration shall be brought before the courts of Toronto, Ontario.

 

14. Termination

We may suspend or terminate your access at any time for violations or misuse. Sections regarding intellectual property, liability, and arbitration survive termination.

 

15. Modifications to Terms

We may update these Terms periodically. Updates will be effective upon posting, and continued use constitutes acceptance of the revised Terms.
